FAMILY PROTECTION ACT CASE
—— An originating summons under .the Family Protection Act came before Mr Justice Korthcroft In the Supreme Court at Christchurch yesterday. The plaintiff was Rhoda Wilkins (Mr E. S. Bowie) and the defendants were the public Trustee as the executor of the estate of Winifred O’CaUaghan (Mr A. C. Perry), mother of the plaintiff, Mrs Ethel Winifred Kirner (Mr C. V. Quigley), sister of the plaintiff, and Warner ©’Callaghan (Mr J. D. Hutchison). Under Mrs O’Callaghan’s will Mrs Wilkins received a legacy of £4O, and Mrs Kirner one of £lO. The balance of the estate, .about £4OO, was left to Warner O’Callaghan. Mrs Wtlklns sought greater provision out of the estate, but his Honour dismissed the case. Costs were awarded to Mrs Kirner. O’Callaghan'did not ask for costs,
