MAGISTRATE'S COURT

—» — WEDNESDAY (Before Mr W. C. Harley, S.M.) MAINTENANCE DEFAULTER Clarence Burnaby, a labourer, aged 36 (Mr A. J. Malley), appeared on a charge of disobedience of a maintenance order. Mr Malley said Burnaby had been sentenced to six months' imprisonment for disobedience of the order. He had been out of gaol only a short time and had had little work before he was fined for masquerading as a detective, and had to serve another month for failing to pay the fine. He had- just come out of gaol that morning when he was arrested again on this warrant. Burnaby had been accepted for the Army, and this would be a solution of all the difficulties. Senior-Sergeant J. Bickerdike said Burnaby, a married man with six child, ren, was evading his responsibilities. He was keeping company with another woman, and any money he earned would not go to the right quarter. SeniorSergeant Bickerdike suggested a remand until Burnaby was ready to go into the Army. "However big a waster he is, there is no sense in sticking him into gaol for six months and then arresting him the day he comes out,” said the Magistrate. "Every time he pokes his head out of gaol he’s hit.” •He thought that an opportunity should be given him to apply for a variation of his maintenance order as he had £217 0s 6d arrears hanging over his head. A remand until Friday was granted to enable the police to see the Army authorities about Burnaby’s acceptance.
