MAGISTRATE’S COURT

MONDAY (Before Mr E. C. Levvey, S.M.) DRUNKENNESS Richard' Sheehan, a second offender, was fined 20s, in default 24 hours’ imprisonment, for drunkenness. For casting offensive matter he was fined 20s. REMANDED George Mason Elliott, aged 60, was remanded until to-day on a charge of stealing a bicycle valued at £7. The Magistrate said he would like inquiries to be made on the prospect of placing the accused in an institution. Robert Nelson Wilde was remanded until March 23 on four charges of theft to which he pleaded guilty, a charge of being unlawfully on premises in circumstances which did not disclose the intention of committing any other crime, on which he appeared for sentence, and another charge of theft for which he appeared for sentence. Three of the theft informations concerned bicycles. The remand was granted so that inquiries could be made about his Army service. Leonard Keith Aldridge (Mr C, V. Lester) was remanded by counsel’s consent, to March 30, on a charge of indecently assaulting a male, RESERVISTS FAIL TO REPORT Arthur Glynn Fuller and Oliver Glen Laing. charged with failing to report for military service, were each sentenced to imprisonment for two months, to be followed by detention m a defaulters’ camp. Fuller read a statement in which he said he*could not reconcile war with his conscience. OIL FUEL REGULATIONS Thomas Keith Dixon, a butcher, was fined £6 for securing 17 gallons of motor spirit for use otherwise than in the terms of his oil fuel licence. Dixon, it was stated by the police, had a licence to enable him to go to his work, but his car broke down, and he allowed seven friends to draw petrol on the licence. Mr Gresson said that what had happened was a breach, but it had been no advantage to defendant and the total amount of petrol so taken on the licence was not very big. Arthur George Elliott (Mr J. H. Poison), for buying four gallons on Dixon's licence, was ordered to pay costs. CHARGE OF ASSAULT Roscna Faith Martin (Mr D. W. Russell), charged with assaulting Thomas Martin so as to cause actual bodily harm, was remanded on bail until March 30, by consent of counsel. For the police it was stated that Thomas Martin was accused's husband, and had now been discharged from the hospital to which he had been admitted after the assault. SUSPENDED SENTENCE Augustine Steven McMahon was convicted and ordered to come up for sentence if called on within two years on a charge of being unlawfully on premises in Cashel street, in circumstances which did not disclose any intention to commit a crime. Sergeant E. J. C. Hay said that as a result of a complaint, another sergeant and himself went to a flat in Cashel street, which McMahon had been asked to leave. Accused left, but wont back again, and the police were .waiting for him. McMahon, seemed to want to be arrested. The Magistrate said McMahon had been very foolish. A condition of the suspended sentence was that the accused was to keep away from the occupier of the flat from which he had been arrested and with whom, it was stated, McMahon had been on friendly terms for some years. INDECENT ASSAULT Patrick McGrath (Mr P. H. T. Alpers), who pleaded not guilty to two charges of indecent assault, one against a girl aged six, and one against a girl aged 10, was committed to the next sitting of the Supreme Court for trial. Bail was allowed in his own recognisance of £2OO, with one surety of £2OO, accused to report to the police as directed. MONDAY MAINTENANCE CASES (Before Mr F, F. Reid, S.M.) Alan Reginald Hutchins, for defaulting in payments of maintenance for (wo children to an of £75 3s, was convicted and ordered to come up for sentence if called on within two years, on condition of payment of 5s a week in addition to current amounts. Separation and maintenance orders were granted his wife against Maurice Stanley Percy Cliff. Maintenance was ordered at £2 a week. A guardianship order and a maintenance order of 25s a week in respect of an infant child were granted his wife against Lullubhai Dajibhai Naik.
