CASE SENT BACK TO LOWER COURT
An appeal by R. J. Weir, Inspector of Awards at Timaru, against a decision in the Magistrate’s Court at Timaru has heen upheld in the Court’ of Arbitration. In the lower Court, the inspector claimed a £lO penalty from Hume Steel, Ltd., for an alleged breach of the award for metal trades employees. It was claimed ■ that two men were not paid the correct rates of pay for the work they .were doing. The Magistrate (Mr H. Morgan, S.M.) found for the defendant company, and an appeal was lodged on fact and law. The Arbitration Court took the view that the work done by the men concerned was not “light manufacturing work” (the point on which the claim turned 1 and upheld the appeal of the inspector.' remitting the case to the I Magistrate’s Court, to fix a .penalty.
