_— * DISABLEMENT THROUGH HEART STRAIN HEARING IN ARBITRATION COURT A claim for compensation for total incapacity to work because of heart trouble allegedly suffered while he was working a concrete mixer was made in the Arbitration Court yesterday by Thomas Alfred John Newman, of Christchurch, a guilder’s labourer. The defendant was R. C. Jamieson, Ltd., a Arm of building contractors. • Mr Justice Callan was on the Bench,, with Mr W. Cecil Prime, employers’ representative, and Mr A. L. Monteith, workers’ representative. The plaintiff was represented by Mr K. G. Archer and the defendant company by Mr C. S. Thomas. Evidence was given describing the nature of the work at which the strain occurred, and of plaintiff’s condition after it. Expert medical testimony was called by each side —Dr. R. H. Quentin-Baxter and Dr. J. F. Landreth for the plaintiff, and Dr. T. C. HandNewton and Dr. M. K. Gray for the defence. Decision was reserved. Settled by Consent Judgment for plaintiff by consent was given in a claim by John Arnold McHarrie (Mr T. Milliken) against Angus M. Fyfe (Mr W. F. Tracy), on a basis which would allow the plaintiff a lump sum of £357 4s. Plaintiff’s claim was for Anger injuries sustained in an accident while in the employ of the defendant. At the time of the accident plaintiff was a minor, and the compensation was assessed on a basis of what he would have received in wages after passing the age of 21.
