NEGLIGENT DRIVING CHARGE

EVIDENCE GIVEN AGAINST MOTORIST (PXEBS ASiOCIATIOST TBUBGBAJf.) WELLINGTON, January 19. Horace Baden Ginger, aged 35, a company director, was charged before Mr J. H. Luxford, S.M., to-day, with negligently driving a motor-vehkrte, thereby causing the death of Samuel Thompson. Evidence was given by Alexander Alfred Boyce that Ginger’s car was completely out of control, swaying from side to side, and taking a zig-zagging course at a speed of 45 miles an hour or more. It passed his car, which was stationary, mounted the footpath, went along it some distance, zig-zagged across the road again, and finally stopped on the opposite side. He noticed a man lying on the footpath. and walked to the scene of the accident.

Walter Henry White said his attention was attracted to Ginger’s car by the erratic course it', was pursuing. After it passed a stationary car it mounted the footpath, travelled a short distance, struck Thompson and afterwards came back on the road and appeared as if to strike witness's cay. Witness swung off to avoid it. It travelled about 200 yards from where Thompson was.struck. Witness said that accused was quite sober. The police- gave evidence of measurements taken.

Ginger pleaded not guilty and was committed to the Supreme Court for trial. His defence was reserved*
