MAREO'S APPEAL
DATE FOB HEARING FIXED
CROWN TO PRINT EVIDENCE

WELLINGTON, March 9. The Court of Appeal, consisting of the Chief Justice (the Rt. Hon. Sir Michael Myers), Mr Justice Reed, Mr Justice Blair, and Mr Justice Kennedy, this morning concluded fixtures for the March sessions at the Court of Appeal and Full Court. It fixed the date for the hearing of the Mareo appeal for March 23. In applying for the fixture in this case, Mr H. P. O'Leary said that as yet it had been impossible to prepare for the trial. The Crown had agreed to print the case, which was of considerable assistance, as there were about 200 pages of evidence, and this, with the exhibits, would mean a .printed case of 250 pages. It was estimated that the hearing of the application would take three days. Mr Taylor, for the Crown Law Office, said .that the Justice Department would see to the printing, but its action in doing so was not to *e taken as a precedent, but was .being done merely because it was understood that Mareo had no funds whatsoever. Mr A. H. Johnstone, K.C., of Auckland, is appearing for the Crown. Other cases of interest set down for hearing include that of Ritchie v. Ridd. a Wanganul breach of promise action, for March 20, and another phase of the case Lysnar v. the National Bank of New Zealand, Ltd., is to be heard on March 27, when Mr Lysnar intends to., appeal from the judgment of Mr Justice Blair* which was given on October 30, and in which damages in the action were fixed.
