♦ WRONG FINGER AMPUTATED IPBBS3 ASSOCIATIO* T/ELEQBAM.) GISBORNE, November 15. Damages amounting to £7OO were awarded by Mr Justice Ostler to Brian Pelham Dods against Dr. Richard J. B. Hall, medical superintendent of Cook Hospital, on a claim for £ISOO damages for alleged negligence in the removal of the wrong finger during an operation for the amputation of a poisoned finger. The operation was performed by the house surgeon, Dr. Russell Thomas, but Mr Justice Ostler held that Dr. Hall, as superintendent, was liable for damages. In a reserved decision, dealing with quantum damages only, his Honour said he had taken into consideration that while the loss of one finger did not reduce the plaintiff's earning capacity, the loss of two would render him incapable of carrying on his calling, at which he had reasonable prosI pects of earning large wages. The loss suffered, therefore, was considerable, I and the damages must be substantial.
