CHARGE AGAINST MOTORIST. I TRESS ASSOCIATION TELEGRAM.) AUCKLAND, July 28. Noel William McColl, aged 23, a stationer, of Otorohanga, is on trial oil a charge of negligently driving a car so as to cause the death Of a youth, David Ellis, at. Takapuna oil May 7. Ellis was found dying on the road on a dark and rainy night, and the Crown alleges that he was struck by McColl's car. The Crown called ;js a witness ac« eused's ;-istcr-in-law, Anne 11, Roberts, who paid that-accused and his wife and child were in the front of the car and witness was in the back. When parsing through Takapuna her sister suddenly became very excited and seemed frightened. Witness thought that her sister said excitedly, "Go on." "We seemed to be all talking at once," continued witness. "My sister , seemed frightened, us though we might ! have struck something. I don't remember what accused said. After a . while 1 think my sister said: 'Noel, I think we hit something.' I felt the slightest sort of a brushing, but no im- ' pact." In answer to many of the Crown Prosecutor's questions the witness said ' she could not remember, and the Judge '. finally remarked: "Is it worth while, Mr Meredith?" The jury returned a verdict of , guilty, with a strong recommendation . for mercy. McColl was remanded for . sentence.
