By the joint application of counsel tl)c case of the Gjtnterp'ury- Central Co-operative Dairy Co., Ltd., v. the Self-Help Co-operative, Ltii., was removed to the Appeal Court direct for argument. Cpunsel said that an appeal would probably bo made whichever way the decision went, and.as there was some question of the legality of the contract under Section 3 of the Commercial Trusts Act.'jSXP, %yhich b»4 not previously been fully threshed out in Court, the removal was deemed advisable. MAGISTERIAL THURSDAY. (Before Mr E. D. Mosley, S.JI.) APPEARANCE FOR SENTENCE. Lawrence Francis Taylor appeared for sentence on two charges of theft at Wellington on May sth, 1980. The charges involved Dip (heft pf goods and. money to the totals of £2 5s and £ll 7s (id respectively. The Probation Officer said that Taylor had appeared at Tiraaru pn June 3{)tb, 1930, lo answer the charges and no liad been re: leased op probation and ordered to make restitution. Since "that date ho had appeared at the Supreme Court pu charges of fqrginf, an,d breaking and entering, and had been sentenced to twelve months' reformative dcteptiun and eighteen months' reformative detention respectively. Taylor was sentenced to three months' reformative detention on thp f)rst charge and six months' reformative detention on the sepond charge. Thomas Eric Kidd appeared for sentence on 18 charges of theft, conversion, and receiving. He was convicted and discharged pn each charge,' the Magistrate saying he would not add anything tp the sentence of three years' reformative detention imposed on Kidd in thp Supreme Court recently. CONVICTED OF ASSAULT. Andrew Parnell McGuire, Lawrence Cowper, and Thomas Andrew O'Loughlin were charged ' with assaulting George Lqwis at Prebbleton' on August 27th. Coaiper was convicted an 4 lined £4. Ip default one month's imprisonment, and' the qthcrs were convicted and fined $2, in default fourteen days' Iffiprisonment. •Robert I'airjio Bennett pleaded guilty to a charge pf assaulting, on August 13th, Clarence Henry Jackson. Sub-Inspector G. B. Edwards said that Jackson had been interfering in accused's domestic affairs. Accused had gone to Jackson's room and there assaulted him, causing extensive injuries. Accused was convicted and ordered to come up for sentence if called upon within six months. HOKSy; WANDERING. For allowing u horse to wander Charles Lilley was fined 5s a.n<i posts. ON LICENSED PREMISES. Maurice Hughes was fined £3 and costs for being found on the licensee) premises of th,o Provincial Ilottl after hours. George Anderson, for a similar offence, was fined £1 and costs. EARLY MORNING DISTURBANCE. Three men, Patrick Duncan, Ike Hannah, and Gerald. Tiplady, were each charged with disorderly behaviour in Gloucester street on July '23 rd, the proceedings arising put of a disturbance which occurred shortly after midnight on the date of the charge. Duncan and Tiplady appeared in Court to answer the charge.' Hannah made no appearance, and there was no proof pf service pf the summons on a fourth man. Police, witnesses included Brian Barrer, a solicitor, and Hugh Thomson, a law clerk, \yba saw the fray. They staled that they had seen seven men engaged jn a fight near the' corner of Gloucester street ano) Montreal street at aboijt i a.m. on July 28rd. Barrer said, that one of fhe men Approached him and asked for assistance for bis friend, whom the others appeared to be attacking. Wit: ness was not anxious to take part, bqt notified the police. Statements submitted by Tiplady and Duucan pointed put that Duncan had considered himself insulted by a certain man, and had decided to fight it out in Hag'.ey Park, Bq*h parties brought witnesses, and. were going down Gloucester street to the park when the accused, Duncan and Tiplady, were attacked. Tiplady was Duncan's witness, the former (aid. Dijaeaa and Tiplady were convicted end discharged.
