FATAL ACCIDENT.
WIDOW AWARDED £I3OO. 'P&CSB ASSOCIATION TELEGRAM INVERCARGILL, November 12. At the Supreme Court the jury awarded Margaret Mcßeath damages amounting to £I3OO, one-third to go to the widow and two-thirds 1 ) four children, in a case arising out-of the death of plaintiff's husband, the driver of a baker's cart, which was struck from behind by a motor-car driven by Roy Wallace. A previous jury had found for £.1250, but a retrial was granted on the ground that the verdict was against the weight of evidence. The second jury found that Mcßeath was guilty of negligence in turning at an intersection without giving warning, but that the real eause of the accident was the negligence of Wallace. Counsel for the defence moved tor judgment, on the findings, for defendant. His Honour said that he would hear counsel later before entering judgment.
