Mr Hunter stated that his Worship, who had sat on tho case, in disposing of it on tho ground of persistent cruelty, should decide whether a new application for a maintenance order stiould lie, or coidd he decide on the evidence lie had already heard. Mr Hunter said the wife was earning £3 a week, and ha<l house property. She was, in fact, in a far better position than the defendant in the case with all those dependent on him. Mr Hoben refused to contribute to his wife's support on those grounds. The charges as to cruelty had not been proved, and the whole case had, therefore, fallen to the ground.
