At tho Wellington Supreme Court !on Saturday the Chief Justice (Sir Robert Stout) gave his reserved decision in the easo recently heard in which Frederick F. Fabian sought an injunction restraining- Florence May Croji from manufacturing and selling "Apex" fire extinguishers, alleging that they were an infringement of hu production, the "Ajax" extinguisher. Plaintiff also claimed £500 dantages. In tho course of his judgment,. Ttii Honour said that it had not been proved that'in purchasing an "Apex" extinguisher any person would be likely to be deceived .into thinking that' ll* was getting an "Ajax." The plaintiff therefore could not succeed. Taking into consideration tho fact of an . ad' journment granted for tho defendant 1 ! convenience, and other matters, hil Honour awarded defendant costs ' according to scale as if £300 had been claimed.
