WELLINGTON. October 14. At the Appeal Court to-diy the case of Guinness end Lo Cren v Quinn was argued. Appellants claimed commission amounting to £[)i> 16s on the sale of respondent's farm at Waimate, which respondent disputed, alleging that one of the conditions on which he ratified tho sale was that he should not pay commission. Appellants' clerk stated in evidence that Quinn had waived the condition. In tho lower Court the magistrate gave judgment for appellants, but Mr Justice Chapman reversed the decision, and from this an appeel was now made. Mr Skerrett. K.C., with him Mr Hamilton, of Timaru. appeared for appellants, and Mr Kinnerney, of Timaru, for respondent. The court reserved its decision..
