DISPUTED CASE.
In the case Robert Dunn (Mr Leatham) v Thomas Flack (Mr Stringer), claim £21 Bs, judgment was given for £4 3s, plaintiff to pay costs. At the Magistrate's Court, Geroldine, yesterday, before Messrs H. W. Moore and W. A. Sherratt, a young man named William Tihomas Morris was convicted and sentenced to three months' imprisonment, with hard labour, for obtaining £3 on false pretences from « laid named William Harris, by representing 'himself as an agent for Oabes, Lowry, and- Co., Timaru, for the sale of bicycles. Accused admitted having received the money, and said he spent it, but intended to return it in a few days, if Harris gave him time. As Mr (Dates had promised him commission on the sale of bicycles, he took it that he was doing in calling himself their agent. William Oates, in evidence, 1 admitted that he had promised accused £1 for the sale of a bicycle, and 10s for sale of a second-hand one, but to be an authorised agent accused would have to sign a written agreement. He did not tell accused that he would! give him all the powers of an agent, and did not know that he had sold any bicycles on his behalf. He had not received any information from accused to that effect, nor had he received any money from him. William Harris and Constable Mullaney deposed that accused told them that he had sent the .£3 to Oates and Lowry, and, therefore, could not produce it. At Southbridge, on Friday, before Mr R. Lyttelton. Mr T. W. Stringer appeared for plaintiff, and Mr T. G. Russell for defendant. After hearing evidence on both sides, the Court adjourned till Thursday, April 2nd, at Chrietchoiroh, to take Mr Fender's evidence, and hear argument.
