His Honour sat in Banco at 12.30 o'clock. WHITE V BROWN. This was a case on appeal from the decision of the Magistrate's Court, regarding the delivery of flour by the respondents, Messrs D. H. and J. A. Brown, flour millers, to Chas. White, baker, Richmond. Mr Weston appeared for the appellant, and Mr Russsell for the respondent. The facts of the case were that the respondents sued and obtained judgment in the lower Court, before Mr Beetham, S.M., for six tons .of flour alleged to be delivered to the appellant. The appellant denied the delivery of the flour, and now appealed. Mr Russell called evidence as to the delivery of the goods. After hearing the evidence for the defendant, his Honour said the appellant's own evidence was so inconsistent that he (his Honour) could not give credence to it, or at all events imply fraud to the respondent. His Honour agreed "with the view taken by the Magistrate. He was satisfied that the evidence given by the defendant was not correct. The anneal would be dismissed, with £10 10s costs. RE SYDENHAM GOSPEL MISSION. Mr Russell mentioned tliis case. He believed a settlement could be arrived at. His Honour said he would be very glad to adjourn it if it would assist in a settlement. The. case was adjourned sine die, and the Court rose.
