Friday, Februart 10. (Before his Honour Mr Justice Dennistcn.'i His Honour sat in Chambers at 11 o'clock a.m. PROBATES AND LETTERS. OF ADMINISTRATION. j Probates were granted in the following I cases:—Re Ed. Elworthy, deceased' (Mr Rolleston); fe Geo. -Gofton (Mr Hunt). ( Letters of administration were granted as follows: —Re Samuel G. Gee, deceased (Mr Beswick); re Finlay Campbell, deceased (Mr Franks). ORIGINATING SUMMONS. Mr Bruges appeared in support of an originating summons in the case of Spackman v Marciel, for an order for the increased 'maintenance of the infants of the testator. After argument his Honour made an interim order for the maintenance and advancement of the children. BRETT V. COX. This was a case of summons for argument of a point of law, in which his Honour required to be satisfied that the question of law was arguable. Mr Beswick, who appeared for Cox, submitted tliat the plaintiff (Brett), having become bankrupt the cause of action passed to the Official Assignee, but did not pass further, and was incapable of being further assigned by him. Brett had, therefore, no right to litigate. Mr Bruges appeared contra. His Honour said he had been shown no instance in which the Official Assignee was debarred from parting with anything he had got. A right of action waa a property which could be passed on to the creditors. His Honour finally refused to consider Mr Beswick's point. Mr Bruges appeared in support of a summons for a special jury in connection with the same case. After argument His Honour adjourned tho case for Mr Bruges to file affidavits showing why a special jury should be granted. BOOTH V. BOOTH AND OTHERS. This was a summons to join the infants defendants, supported l by Mr Bruges. Mr Beswick appeared on the other side, contending that there was no reason why the infants should be joined. His Honour granted an order for them to be joined. ORDER FOR COMMISSION. Re H. J. Washbourne, deceased (Mr Wynn-Williams), report re commission. An order for commission was made as prayed. -
