VJ.I Civil Casks.— Bing v Swindell, cWim £6j Mr Deacon appeared for the defendant, to whom plaintiff sold a piano worth £30 for £24 on condition that he should keep it for his own use. Defendant, however, soon afterwards sold the instrument for £35, and plainti ft* now clai mod the cum sued for rs profit ne would have made in an ordinary sale. His Worship said the alleged stipulation woe of no value, and, without calling on the defeuce, nonsuited the plaintiff with costs. In Stauaton and Oragg v Bailee £4 5s W, and Bowman v Shaw, £2 10s, on judgment summonses, the ability of the debtors to pay was not proved, and orders were ra« fused. went for plaintiffs by default, with costs, in Rayner v ffurper, 10V 6d, and Glanville v Byrne, £4 7e 6d. In Dodd v Carter, claim 5s for wages, jndg* ment was for the defendant. Luney v Thompson was adjourned till September 2nd.
