COMMITMENT OF DEBTORS.
(PRBSS ASSOCIATION TELEGRAM.) DUNEDIN, August 25. A case cropped up in the Stipendarf Magistrate's Court this morning, iv wh|on an- application was made for an order for the commitment of a debtor in default of payment of a debt, the debtor having alteady served one sentence in respect of the same debt. Mr Barclay, who made the application, argued that the man was punished by. having an order made against him, not because he had ,not paid the debt, but because he had been guilty of contempt in refusing to obey an order of the Court. So far as the digest- of cases went there did not appear to be any cases in which a man had been imprieoned a second time for the same debt. The Magistrate pointed out that in the casa of ft dew being made payable by instalment*, then each instalment could be treated as * sepa* rate debt, and, failing the individual payments, an order in each instance 00a10,.w obtained. In the present instance, however, that could rot apply. He knew that several Magistrates had said that they tm no power to imprison a second time in respect to the same debt. The order was accordingly refused.
