Plaintiff allJ** that on May 27th he made a cSnet b?£ ageut with defendant for the purchase of SO tons of potatoes at £1 15s per ton. Oα June 10th some of them, when ready for delivery, were examined and found to be »"* •'J 11 '. 1 *> *«nple, and plaintiff required them to be picked over. Defendant did cot deliver them, bat sold to another party Potatoes had risen in value eiace taecontaacfc, »ad plaintiff bow claimed as damages at the rate of os per ton, which would have beau his profit on the transaction if completed. The defence was that plaintiff had rejected the potatoes, though defendant had made arrangements to again sample them in the presence of plaintiff, so as to showthat they were what they wdre represented to be, but plaintiff did not keep hie appointment and the potatoes were itnmedutely taken by other bayera at the same price. Judgment was for the deien<lant with costs.
