Defendant did cot deliver them, bat sold to another party Potatoes had risen in value eiace taecontaacfc, »ad plaintiff bow claimed as damages at the rate of os per ton, which would have beau his profit on the transaction if completed. The defence was that plaintiff had rejected the potatoes, though defendant had made arrangements to again sample them in the presence of plaintiff, so as to showthat they were what they wdre represented to be, but plaintiff did not keep hie appointment and the potatoes were itnmedutely taken by other bayera at the same price. Judgment was for the deien<lant with costs.
