WELLINGTON, May 15.

The Tax Commissioner sued the Rev. J. C Andrew, of Maeterton, for £35 7a Sd as abaeetee tax, and £3 6s 9d iuterest, on 14,890 acres in the Oero district, Hawke's Bay, belonging to Robert Curling, of London, tor whom defendant is agent. The defendant claimed that he was not liable for the amount claimed, principally on the grounds that he had been resident within the colony fur the period required by the Act, and that if Robert Curling had been reaident out of or absent from the colony for a- period of three years, still he was not liable to the tax, as "the Act ouly applied to such persons as had been absent from or resident out of the colony for a period of three years and had not left an agent to represent them in the colony. The defendant further said that he did not admit that Curling had been absent from the colony for the space of three years. After evidence had been taken and argument heard, judgment iras given for plaintiff with £3 13s costs. The defendant gave notice of *ppeaL
