Thursday, February 5. Before his Honor Mr Justice Denniston.) The banco sittings were resumed at 10 a.m. ackroyd (appellant) v bishop (respondent). Mr Hay, with him Mr Salmond, for the appellant; <ir Joynt for the respondent. His Honor, without calling upon Mr Joynt to reply, gave judgmeut, dismissing the appeal with £10 10s costs, holding that the Court making the order for the imprisonment of the respondent was not a properly constituted one.

This was a case in which the' Waitaki District Hospital aad Charitable Aid Board was appellant and the South Canterbury Hospital and Charitable Aid Board was respondent, and the appeal was from the judgment of the Resident Magistrate at Timaru, in a case iv which the respondent Board was plaintiff aud tbe appellant Board defendant. The facts of the case were as uuder:—One Thorn is Dodds, a tailor by trade, with his wife and family, resided at Kurow, within the district of the Waitaki Hospital aud Charitable Aid Board, for a period of four months. After residing at Eurow, as stated, Dj.ids removed to Oamaru, and remained therefor about eleven months. He then left for Timaru, where he resided frjm October, 1889, to 15th M ly, 1890. He went into the Timaru Hospital ou 11th April as a patient, and there incurred to the respondent Board a liability of £8 10s for maintenance, &c. The respondent Board also supplied rations to the wife and family of Dodds. The total liability incurred was £9 2s 6d, and judgment was given for the plaintiff for the same with costs, and this judgment was now appealed against. Mr Huy appeared for the appellant, and Mr Joynt for respondent.
