Breach of Harbor Rbgulations.— Robert Swan, Master of the ship City of Delhi, was charged on the information of the Harbor-Master at Lyttelton with allowing rubbish to ! be cast over from the City of Delhi into the harbor at Lyttelton, instead of seeing that ib was placed on the trucks on the wharf for the reception of rubbish. Captain Swan pleaded not guilty. Mr H. N. Nalder appeared for the Harbor Board, and called Captain J. W. Clarke, Harbor-Master at Lyttelton, who said that it was the custom to deliver copies of regulations and circulars to masters of ships coming to the port. He delivered the copies ni-nself to Captain Swan. There is a railway truck at the wharf end for the reception of rubbish, and witness having noticed that there was a lot of rubbish about the City of Delhi in the water, made enquiries. The charge'was denied on board at first, but ultimately was acknowledged. Captain Swan said he gave strict orders when he received the circular, &c, that nothing was to be thrown over the side.. The onencO was committed when he was away from the ship. The chief officer corroborated the captain's statement, and said that no one had put the rubbish over the side to ~his Knowledge. The third officer was in charge of the men, and he received orders from witness to put the rubbish at the end of the wharf. The Bench inflicted a fine of £5 and £2 2s costs.
