Plaintiff alleged that he began to pull down a fence erected by defendant over a road which he claimed, when defendant came up and struck him in the back with tbe fiat b_ a gorse knife, and drove him away; The statement was corroborated by two witnesses. Mr Russell pointed.out out that, as his client claimed as his. ow&_ the land called by the plaintiff a road, there was a question of title involved, ana their jurisdiction was ousted.
