♦ SITTINGS AT NISI PBIUS. Friday, August 31. [Before his Honor Mr Justice Ward and a Special Jury of four.] The Court re-opened at 10.30 a.m. BBTJNTON V CLIFTON. The hearing of this case was resumed. Mr Fisher for the New Zealand Loan and Mercantile Agency Company, did not call any evidence. Learned counsel addressed the jury. His Honor having summed up, The jury returned a verdict on the issues submitted as follows: — ' 1. Did the defendant Edmund Clifton prior to the plaintiff entering Into the agreement of the 22nd September, 18—, agree that the plaintiff should beat liberty to catch and kill rabbits on the Clarence River for the purpose of feeding the ferrets to be bred by him under the said agreement, subject to a discretionary power on the part of the said Edmund Clifton as to the places in which the plaintiff was to rabbit, provided that the plaintiff was afforded reasonable facilities for getting sufficient rabbits to feed his ferrets ?~~ — _Tcs_ 2. Did the plaintiff enter into the agreement of the _nd day of September, I—B, upon the faith of the said agreement, as to catching and killing rabbits for feeding the said ferrets ?—Yes. 3. Was the plaintiff allowed to exercise the right of catching and killing raboics in conformity with the said agreement*— No. 4. What damages, if any, ls the plaintiff entitled to recover ?—£2l3, exclusive of amount paid into Court. His Honor gave judgment against the defendant Clifton for J_l3 and costs on middle scale. Mr Fisher, for the New Zealand Loan and Mercantile Agency Company, applied that the costs of the Company should be paid by the defendant Clifton.
