The parties did not meet until some time afterwards, Accused was then bankrupt, and told prosecutor that he had the waton "safe." Prosecutor next saw the watcl at Fainter and Baker's pawn shop in Gloucester street. Accused was then in Napier, having been absent from Chriatohurch abcut three weeks. Prosecutor had not authorised accused to pawn the watch. To Mr Holmee—Witness oweS other borrowed sums to accused besides the jB3. Accused, before leaving Chrietchurch, applied for the refund of these loans, and witneee might have said " you have the watch which yon can use to pay yourself." Witnesenever thought that accused intended to deprive him of the use of the watch, and he might have assented to the watch being pawned by Triggs. Witness, although he BJgned the information, did not initiate the prosecution. Edward Painter, pawnbroker, stated that the accused on the Bth December, 1885, pawned with witness the watch and chain produced for JEIO. Accused gave the name of " Brown." Witness knew tbat his real name was Trigge. To Mr* Holmes—Hβ knew Trigge very well. This was all the evidence. Mr Holmes submitted that there was no case to go to the jury. There were two ingredients necessary to constitute the offence. viz., the want of consent of the owner, and the fraudulent intention.
