RESIDENT MAGISTRATE'S COURT.
LXTnttwm.— -January 7, 1865. [Before Wx. Dohazd, Esq., RJ£; and A. W. Sbxbd, Esq., J J"2 Robert Montgomery, carpenter of the ship W. H. Haselden, was charged with assaulting the mate, and threatening the other officers on board ship. The prisoner having produced some evidence in extenuating his conduct, was only sentenced to a week's imprisonment. IC'Michael t. Peacock & Co.—The plaintiff sned fin-damages on account of hisnot having been provided with an enclosed steerage berth on board the Dona Anita, aa specified in his contract ticket signed by the charterers, Shaw, Saville & Co., London, and for which he had paid £8 extra. B. Buchanan, of the firm of Peacock & Co., dented their liability, they being only agents for the owners Messrs. Seymour, Peacock & Co. of London, and not agents for Shaw, Saville & Co.; also, that the plaintiff ought to have made his complaint at Oraresend or at Invercargill. TneOoart dismissed the case, but recommended the plaintiff to proceed against the captain and owners.
