DAMAGES CLAIM
VERDICT FOR PLAINTIFF
Judgment for plaintiff was given to-day in the claim before Mr. Justice Johnston and a special jury in which Gilbert Rollinson Fuller, orchardist, aged 24 (Mr. Sullivan and Mr. MacKay) sought from Winstone, Ltd. (Mr. Leary) £226 special and £1000 general damages. The claim arose out of a collision between plaintiff when cycling near Henderson and a truck driven by a servant of the defendant, resulting in injuries to plaintiff's back and left arm. Medical evidence as to the duration of plaintiff's incapacity through the injuries was conflicting. The truck driver, Harry Borrows, said he saw the cyclfst coming straight at him, and slowed up and sounded the horn, but the cyclist collided with the lorry. Counsel for both sides addressed the jury to-day. His Honor summed up, and after less than an hour's consideration the jury returned a verdict for £226 special damages, as claimed, and £500 general damages, with costs.
