TWO MEN FINED
INTOXICATION CHARGE Fines were imposed on two men who came before 4 Mr. J. H.'Luxford, S.M., in the Police* Court' to-day, for being in a state of intoxication while in charge of a motor car. In the case of Thomas Henry Winks, a fruit packer,.aged 38, who pleaded not guilty, to being in a state of intoxication while in,charge of a car in Rimu Street, New Lynn, on September >26, Mr. Allan Moody, for accused, submitted that Winks was not the driver of the car. Winks was fined £15 and disqualified from holding a license for twelve months. "If the evidence of the doctor was all that was concerned I would have to dismiss the <* charge, but the evidence of the police is so specific," said the magistrate in convicting John Thomas Hurst, aged 22, a motor driver for being in a state of intoxication while in charge of a car in Emily Place early on the morning of September 27. Mr. J. J. Sullivan appeared for Hurst who denied the charge. Dr. Usher, who examined the accused at 3.10 a.m. on September 27. said he could not say that Hurst was intoxicated because he passed all the tests given him. A fine of £10 was inflicted. The magistrate disqualified Hurst from holding a license for twelve months.
