CASE DISMISSED.
GARAGE USED FOR MEALS. OTAHUHU PROSECUTION. Reserved decision was given yesterday by Mr. W. R McKean, S.M., in a case which was heard in the Otahuhu Police Court on March 18, when Leslie Frank Spray was charged by the Manukau County Council with using a building at Eastern Beach as a dwelling, when the permit applied for had been for the erection of a garage. It was stated that in December of last year the county inspector, Mr. W. Murray, found that the defendant and his wife had furnished the garage with a table, chairs and cooking appliances, but were using a tent for sleeping p Ur - In dismissing the case, the magistrate said that the defendant's occupation of the tent was not a contravention of the by-law. No case bad been cited in which it had been held that a person raided in or inhabited a place in which he had his meals.
