ROAD ACCIDENT SEQUEL.
APPEAL AGAINST DECISION. (By Telegraph—Press Association.) WELLINGTON, Friday. The Court of Appeal reserved decision in the case of Orr versus Reynolds. Mr. F. C. Jordan appeared for tiic respondent, William Ancell Reynolds, of Auckland, in an appeal brought by Ronald George Orr (Mr. L. G. West), of Auckland. The case arose out of an action in which Reynolds claimed £640 damages against Orr for injuries received in a collision between his motor cyclc and a stationary motor car on February 22, 1938. Reynolds contended that the collision was due to the negligent driving of Orr, who drove another motor car out of a side road as Reynolds approached the intersection, causing him to swerve and strike the stationary vehicle.
The jury in the Supreme Court awarded Reynolds £557 damages. Orr then applied to the trial judge, Mr. Justice Fair, for a non-suit against Reynolds, or for a new trial, on the grounds that the verdict was against the weight of evidence, and that the judge had misdirected the jury in summing up. This application was refused and judgment was entered in accordance with the jury's verdict. The appeal was from Mr. Justice Fair's refusal to grant judgment for defendant, a non-suit or a new trial.
