David Stewart, second-hand dealer, Mount Kden Road, said that on August 7 he locked up his shop about 5.30 p..n. Accused gave evidence and said that on the day in question he had more drink than he should, which accounted for his actions. He said the complainant was mistaken in saying accused attempted to strike him with a bottle. Accused, who had previous convictions, was admitted to probation on the charge of assault, sentence on the other charge being deferred for one week.
