"\fr. Stewart is mistaken when he says I attempted to hit him with a finger beer bottle. It was a beer bottle I had—■ringer beer is against my religion," said William Ingram, storemaii, aged 02, when he appeared before Mr. F. H. Levien, S.M., in the Police Court to-day charged with being found without lawful excuse in the shop of Devid Stewart, Mount Eden Road, and al*o with assaulting David Stewart. Accused pleaded guilty to the first charge and not guilty to assault. Sub-Inspector Fender prosecuted. David Stewart, second-hand dealer, Mount Kden Road, said that on August 7 he locked up his shop about 5.30 p..n. A few minutes later he heard m nois L >. and on going into the shop found accused at the door trying to open it to get oik. Witness opened the door and accused, who had «t ginger beer bottle in his hand, made an attempt to striku witness with it. Witness took accused, who offered no resistance, to the Mount Eden Police Station. Accused had had some drink. About six weeks previously witness found accused in the shop after it had been closed, and on that occasion witness allowed him to go. Accused gave evidence and said that on the day in question he had more drink than he should, which accounted for his actions. He said the complainant was mistaken in saying accused attempted to strike him with a bottle. Accused, who had previous convictions, was admitted to probation on the charge of assault, sentence on the other charge being deferred for one week.
