Paterspii; S.JL, inVthe''Police Court to-day,"when Andrew; H.. Burn, ' a earner-,./of: Hamilton, -was ■ charged •with employing;a 'driver.for more than 11 hours ph one day. Evidence was given by_ Mr. :G.- D. Treadgold, of the. Labour Department, that defendant's ■ employee, , Percy ■ Smale, had /informed him .that he. had been working for nearly' 12 hours on December 23. . .-•"..-, /' • .Defendant produced a time book which showed that Smnle had been employed for a period ol 12J hours on the date mentioned. He stated, however, that he had allowed. ! Smale; reasonable time .in. which.'to the; jobs--allqtted.i to" him within" the 11 hours provided in the regulations. •'" '"' -' r " : ' Mr. Paterson said the regulation proTided that an employer. must .not cause or permit an /employee to' work "more than ir hours. 0 ;In this : case 'the defendant .allowed reasonable ,time 'for the work to be done within the specified period, and that- being so, it could >not be said that he caused or,permitted a_ breach of the regulation.
