Witne-s stated that, he was stabbed in the neck and blood spurted out. Taken to Hospital. Wilness said he tried to take the knife from her. but did not succeed, as he was too far gone from loss of blood. Accused ceased attacking him and disappeared, and witness asked her husband to send for an ambulance. When the ambulance arrived witness was taken to the hospital, where he was an inmate for It) days. He also denied that he had had considerable liquor either that morning or the previous night. Heard Call for Help. Mrs. Delia May Connor, residing next door to the accused, said that on Christmas morning Cox had been in her house nnd she had ordered him out because lie was very drunk. Mrs. Scully had visited her that morning. Mrs. Scully was perfectly sober. Later in the morning witness heard Mrs. Scully calling out "Help!" and Mrs. Scully came into witness' home. She had a bruised eye, broken teeth, skin on her face cut, and her dress torn. She complained tlint Cox had tried to commit a certain assault upon her. Mrs. Scully was perfectly sober. In answer to Mr. Aekins witness said Mr*. Scully's appearance was in keeping with the complaint she mnde against Cox. The statement bjr Cox that there were about ten men tn witness' yard with a ten-gallon keg of beer that morning was not true. Police Produce Statement. Det,cct!vo A. Wilson produced a statement, signed by the accused, in which she admitted the assault, but explained the provocation which had led up to it. Mr. Aekins submitted that the case was not one that should go to a jury. The evidence of the complainant Cox had been discounted by another police ■witness, Mrs. Connor. Counsel said it •was quite clear what had led up to the assault, and it was unlikely that any jury would convict the accused. Hl« Worship said he considered a ftrima facie case had been made out and t was a matter for a jury to decide. Accused pleaded not guilty and (.was committed to the Supreme Court for trial.
