RECOVERY SOUGHT.
KENNEL CLUB'S BOOKS. PLAINTIFF NON-SUITED. (By Telegraph.—Own Correspondent.). WAIHI, this day. Troubles connected with the Waihi Kennel Club, which was formed last year, culminated in a civil action brought by the club (Mr. F. C. V. Clark) in the Magistrate's Court yesterday against its former secretary and treasurer. Alan Faltersoii, police constable of Waihi, for the recovery of certain l>ooks. papers, a receipt book, a list of trophies belonging to the club and the members' register. Failing possession of these chattels, the plaintiff club claimed the sum of £10. and, in addition, a further .£ls damages.
Counsel said tlie articles in question were necessary for the continuance of the club. Formal evidence Was given by C. Copestakc, president of the club. In answer to defendant, who conducted his own defence, witness admitted that defendant had done the lion's share of the work of organising the inaugural show. H. L. Bougliton. solicitor, who is the club's auditor, said that lie had certified the accounts as correct. Defendant said the books and papers had .been burnt after the audit because he was. disgusted with the club. The magistrate, Mr. F. H. Levien, said there could be no penalty on the defendant in a civil way. and lfe did not know any legal principle that applied to the case. "I have had 110 interest in this case, and that always indicates to me that there is something wrong with the proceedings." said Mr. Levien. who added: "If there were anything to look into I should have been extremely interested." The plaintiff club was nonsuited.
