MAGISTRATE'S DECISION.

An application for possession of a I dwelling and four acres which had been sold for £900 to a man who wished to farm the property was the subject of a reserved decision given by Mr. F. H. Levien, S.M., in the Papakura Police Court yesterday.

The case was one in which Mrs. Edith Smeed, widow, of Auckland, sued D. Glasgow, of Papakura, for possession. His Worship said the property, which was three-quarters of a milp away from the township, was used by Glasgow, who was a drover, to provide accommodation for his two horses used in the course of his business. There did not appear to be any question of hardship on the landlord, as she was getting 27/6 a week, whereas if she invested the money at the ordinary rate of interest about 15/ a week would be her income.

The order for possession was refused, with costs to the tenant.
