CLAIM FAILS.
TAXI DRIVER'S MISHAP.
A taxi driver's claim for damages arising out of a, collision with a safety zone at the top of Symonds Street at three o'clock on the morning of February 19, 1936, s concluded at the Supreme Court yesterday afternoon before the Chief Justice, Sir Michael Myers, and a jury of four. The plaintiff, Harold David Lincoln (Mr. Haigh), claimed that the negligent driving of Hugh Em met t O'Shea (Mr. Goldstine), milk vendor, in coming out 'of a lane caused him to swerve into the zone. He claimed £300 general damages and £174 0/ special damages. In addressing the jury, his Honor said he did not think they need find the case a difficult one to decide. The plaintiff's case depended on the allegation that the defendant had put his van back from the road after the accident and turned on his lights. After a retirement of an hour and a I half the jury found a verdict for the defendant, who, it wae considered, had not been guilty of any negligence. Judgment was entered accordingly.
