TAXI HITS SAFETY ZONE.
CLAIM FOR DAMAGES
A taxi driver's collision with a safety zone at the top of Symonds Street, on February 16, 1936, had a sequel in the Supreme Court this morning when he brought a claim for damages against a milk vendor, who he alleged, negligently drove his car from a side road and caused "him to swerve into the zone.
The plaintiff was H. D. Lincoln (Mr. Hsiigh) and the defendant H. E. O'Shea (Mr. Goldstine), milk vendor, of Dominion Road. Plaintiff claimed £174 special and £300 general damages for injuries he had received to his head and knee. The case was heard before the Chief Justice, Sir Michael Myers, and a jury of four.
It was contended that the defendant's negligent driving was the pause of the accident it being alleged that his vehicle was insufficiently lighted and that he did not k£ep a proper look out as he emerged from the narrow street known as Winstone's Lane.
For the defence it was alleged that the accident was due to plaintiff's own negligence and that there was no need for him to swerve from hip course. The defendant denied that he had encroached six feet on the road when the plaintiff was passing and said that his vehicle had only reached the gutter^ The case is proceeding.
