BREACH OF AWARD.
DEPARTMENTAL ACTION
ESIPLOYSIEXT OF VULCAXISER. "The Inspector of Awards, Sir. G. F. Grieve, proceeded against India Retreads and Rubberware Company, Ltd., ,in the Slagistrate's Court yesterday afternoon before Sir. Wyvern Wilson, S.SI., claiming that there had been a breach of the Dominion motor mechanics' award by the action of defendants in employing a vulcaniser, who was over 21 years of age, and paying liim £2 a week, instead of 1/9 A an hour for a 44-hour week. Sir. L. G. Simpson, for the defendants, contended that the award fixed the rates for vuleanisers' assistants for a | period of five years, and therefore, as tho employee had not served five years, they were in order in paying him the appropriate rate for an assistant with similar experience, notwithstanding the fact that lie had advanced to 21 years. Sir. Simpson claimed that until the employee had completed five years' service he was not entitled to the fffll award rate. The magistrate, Sir. Wilson, said that if a man over 21 was engaged without experience he would have to be paid a journeyman's wage. There did not appear to be an obligation for a man to serve five years before getting the full rate of pay. Sir. Simpson contended that a man was an assistant until he was fully qualified, and that only an experienced man should receive the award rate. Tlie magistrate said that the facts were not disputed, and it appeared to him that the employee was entitled to the award rate. A vulcaniser was an adult person. He held that a breach had been committed, and imposed a penalty of £2 and costs.
