COURT OF APPEAL.
CASE OF ELDERLY MAN. In the Supreme Court yesterday morning Mr. Justice Callan decided to state a ease for the Court of Appeal; in regard to James Moore, labourer, aged 03, who was found guilty at the recent criminal session of the attempted indecent assault of a little girl near Bombay.
The evidence at the trial was that Moore asked the girl to come and have a cup of tea with him, and offered her as an inducement a necklace. On his arrest Moore made a statement to the police. He was found guilty of attempted indecent assault.
In the Court yesterday Mr. Noble submitted that Mogre's action did not constitute criminal intent, and his Honor agreed that the'matter should go to the Court of Appeal.
