ASKED TO RESIGN.

MT. EDEN TOWN CLERK

RESOLUTION OF COUNCIL RESCINDING MOTION PENDING. The Mount Eden Borough Council last night confirmed a resolution carried by the council in committee on July 10 giving the town clerk, Mr. H. Gribble, the opportunity to resign. The resolution read: '"That the report of G. W. Hutchison, Esq., be shown to the town clerk and his Worship the Mayor express to him the decision of the council and that he be given the opportunity to resign. Failing acceptance that he bo relieved of his duties as town clerk and treasurer as from November 1, 1935, and thereafter ho be retained on the staff of the council in some capacity more in keeping with his qualifications." When the Mayor, Mr. T. McNab, moved the confirmation of the minutes, Mr. W. J. Gatenby said that the minutes, while not incorrect, were incomplete, in that on one particular matter his vote was not recorded against the motion. Mr. McNab: You did not ask to have your vote recorded against it. Mr. Gatenby: Ido so now. I voted against it. Mr. McNab: Well, you should have asked that your vote be recorded against it. I move the confirmation of the minutes.

Terms of Motion Questioned. Mr. S. E. Chappell: The motion as recorded in the minutes is not the motion we carried. I want to say definitely that in one particular alone tho minute is not the whole of the motion wo considered. The officer had seven days in which to hand in his resignation. Mr. McNab: That was not carried. Mr. Chappell: That was the motion, and some of us took exception to it. Mr. McNab: I have the pencilled notes here. Mr. Chappell: What is written there I don't know. The motion that was moved mentioned seven days. Mr. McNab: I say that was not carried. Tho minutes were then confirmed, Messrs. Gatenby and Chappell voting against.

When all other business of the council had been dealt with Mr. Gatenby gave notice to move at the next meeting that the proceedings in committee on July 10 were out of order and should be declared null and void for the following reasons: That they were not in the agenda paper and councillors had no notice thereof; that they were begun after 10 p.m. without any suspension of standing orders Nos. 16 and 27; that councillors had no opportunity of reading and studying the report of Mr. Hutchison and had not yet seen it; that the town clerk was given no opportunity of replying to any accusation or complaint made against him; that no recommendation to degrade the town clerk was contained in the report of Mr. Hutchison. The Mayor: I will be definitely against that. You are quite incorrect.
