WORKMAN'S INJURY.
CLAIM MADE TOO LATE
Compensation wa* claimed by a Dalmatian labourer. Mate Mareioh, before Mr. Justice Frazer In the Arbitration Court yesterday from tlie Public Works Department for injuries received following an accidental blow on the head. Plaintiff was represented by Mr. ft. Elwarth, and Mr. V. R. Meredith and Mr. R. Meredith represented the defendants. Plaintiff said that on October 3. 1033, while employed by the Public Works Department at Matakana, he collapsed, and had ever since been totally incapacitated. He declared that the collapse wa* due to an accidental blow on the head by a hammer, received whilo lie was previously working for the Department, His average weekly earnings had been £3 2/. He claimed £1 medical expenses and such compensation as the Court thought fit. The defence admitted that plaintiff bad received an accidental blow on the head from a hammer, but denied that he was entitled to compensation. Mr. Elwarth explained that plaintiff had been working with a drill, and the foreman of the job had been working with a hammer. The head of the hanii mor flew off and hit plaintiff on the head. On the ground that the claim had not been brought within the prescribed time, judgment was entered for the Crown.
