COST OF HOUSE.

A KERIKERI DISPUTE. CONTRACTOR AXD OWNER. The dispute arising from the building of a dwelling at Kerikeri, Bay of Islands, in which the contractor, Arthur Edward White, an engineer (Mr. Lcary), is claiming £291 4/4 for alleged extras and incidentals from Ernest Park Muir (Mr. Goldstine and Mr. Wilson), who is

counter-claiming for £2(38 4/4 for alleged negligent and defective work, is being continued at the Supreme Court, before Mr. Justice Fair.

The plaintiff was in the witness box the whole of Tuesday and part of yesterday. In - cross-examination ho admitted that the contract had taken three months more than the specified time, but contended that was largely due to defendant's interference and to the alterations.

Asked by Mr. Goldstine whether his creditors were financing the action, plaintiff asked liis Honor whether he was required to answer the question.

Mr. justice Fair: I do not see that it is relevant.

Mr. Goldstine submitted that it directly affected the action and was a matter the Court should have cognisance of, in the event of an order being made. | His Honor: At that stage it might be necessary to consider it. At present I rule that Mr. White is not obliged to answer the question, because it might expose him to indemnity. Evidence of the cost of special windows which were substituted for those in the original specifications was given by Thomas M. Pollard, of Messrs. Briscoe ancl Company. The extra cost, he said, was from £40 to £50.
