FELL DOWN LIFT WELL.
DAMAGES CLAIM FAILS. (By Telegraph.—Own Correspondent.) HAMILTON, this day. In a lengthy reserved decision delivered to-day, Mr. S. L. Paterson, S.M., held that defendant was not liable in the case in which Noel Clifford Jones, clerk, of Hamilton, claimed £141 damages from the Hamilton Methodist. Church trustees, proprietors of the Wesley Chambers, Hamilton. Plaintiff fell down the lift'well in defendants' building, owing to a defective lock. The magistrate, in giving judgment for defendants, with costs, held that plaintiff failed to exercise reasonable care and observation, that he was a licensee and not an invitee, and that defendants were not under a statutory obligation to pro.vido protection. Security for appeal was fixed at £10 10/.
