"FLOUTED THE LAW."
UNLICENSED GOODS SERVICE. REHEARING REFUSED. (By Telegraph.—Own Correspondent.) HAMILTON", this day. "I have no doubt that this «ian was deliberately flouting the law," observed Mr. S. L. Paterson, S.M., at the Magistrate's Court to-day, in refusing an application for a rehearing in the case in which he recently convicted and fined Clifford Day, a carrier, £25 for operating between Auckland and Taupo without a goods service license. Mr. N. S. Johnson, for defendant, said it was recognised now that under the Act there was not a legal defence in the case as the facts were admitted. He pleaded, however, for a reduction in the penalty. The traffic inspector, W. E. Nicholson, opposed a rehearing on the grounds that defendant had defied the law. Since his conviction witness had caught him on the highway with more goods for Taupo. The fine was not a deterrent. The magistrate considered the penalty not excessive, considering that defendant flouted the law. It was only a quarter of the fine he could have imposed.
