APPEAL ABANDONED.

Reference to mechanical deyices known as fruit machines, which were popular in Auckland tobacconists' shops ■ until ruled to be illegal, was again made in the Supreme Court this morning.

When the case Was before Mr. Justice Herdman last April, two points were i;aiscd —whether the game was one of chance, and whether the shop where the machines were operated was a common

gaming house.

At a rehearing of the casfe, brought by way of an appeal against the decision of Mr. P. K. Hunt, S.M., Mr. Justice Hcrdman decided that the game was one of chance.

The question of moving the second legal point to the Court of Appeal has now been abandoned, and the appeal was to-day dismissed by his Honor with £10 10/ costs and witnesses' expenses.
