DAMAGES AWARDED.

SYMONDS STREET ACCIDENT. A MAJORITY VERDICT. ! After a retirement of nearly four hours tlie jury in the action Karews v. Holton yesterday awarded the plaintiff £500 general damages and £HG special damages on account of injuries received in an accident in Symonds Street on February 23 of last year. The verdict was a majority one of nine to three. The plaintiff was Michael Walter Karews, bus driver, and the defendant Arthur Stanley Holton, carrier, plaintiff being represented by Mr. F. W. Schramm, and the defendant by Mr. A. H. Johnstone and Mr. J. F. W. Dickson. The case had been previously before the Court, and a jury found a verdict for Karews, but owing to one of his witnesses, a man named Cheadle, giving false evidence, and afterwards being convictcd of perjury and sentenced to three years' imprisonment, the verdict in favour of Karews was set aside. The jury yesterday found both plaintiff and defendant had been negligent, but held that the negligence of the defendant, Holton, was the real causa of the accident. They awarded plaintiff £Gl6 17/6. , . , Mr. Justice Smith entered judgment accordingly for the plaintiff, with costs according to scale, witnesses expertises and disbursements to be fixed by the registrar. On the application of Mr. Johnstone his Honor extended the t!me for making application for a new trial to 14 days. The question of costs on the first trial was reserved.
