NEGLIGENCE CHARGE.
MOUNT EDEN FATALITY* ' MOTORIST BEFORE COURT. Twenty-one witnesses are to be called for the Crown in a case which opened in the Police Court thie morning before, Mr. W. R. McKean, S.M. John Isidor' Weingott was charged with.. negligently driving a motor car so as to cause the; death of Henry Lloyd Dartnall, and also with causing actual bodily harm to Sarah Brookholding Dartnall. Mrs. Martha Harding said she had visited deceased and hie wife at 59, Balmoral Road on August 18. They returned to her houee for tea, and then left to go to a religious meeting in the Tui Street HalL Evidence was given by a number of tramway employees as to the time trams passed Balmoral Road. Harvey Bateman said that he was driving a van towards Three Kings. Just Balmoral Road he saw a tram going in the same direction. Two people were standing in front of a tram. They waited until it moved away and then walked acrpss the road, arm-in-arm. They were very elderly. A motor car came from the direction of Three Kings. The couple were knocked down about the centre of the concrete. He could not Bay anything regarding the speed of the vehicle. Hβ could not recall the sound of any horn sounded or the screech of brakes applied. The car was pulled up about three car lengths from where the injured persons were lying. He would think that the victims were carried roughly 18ft by the impact. He did not see any other tram coming into Balmoral Road or near that road at the time. He sould have seen any such tram. George Willis, who was in the van with the previous witness, said his friend grabbed his arm and said, "Look what is going to happen." As that was said, he heard a bang. He jumped out of the vehicle, ran across, and saw a woman lying on her back, a man was also lying on the street. They would be some 6ft apart. (Proceeding.)
