STRUCK BY MOTOR CAR.

PEDESTRIAN INJURED. CLAIM !FOR iDAMAGES, A sum of £500 ■ was claimed in a case at the Supreme Court this morning before Mr. Justice Smith, the -plaintiff being George William TTa.'nnan, of Hikutaia, butcher, and the defendant John Edgar Irwin, taxi driver, Auckland. Of ■the sum claimed £165 $ra& for special damages, which included £90 :for lose of wages, £io for a euit of clothes, and £2 for a pair of spectacles that were broken. Mr. Noble appeared for plaintiff and Mr. 'Richmond, for defendant. The case arose out of an. accident which occurred on the evening of August 23, 1930. Plaintiff was crossing Upper Queen Street when !he was knocked, down by a taxi driven by the defendant. Plaintiff alleged, that the car was travelling at an excessive epeed. Hβ said he did. not see it coming and it was on tap of him before ihe knew. He denied that he came out from -behind a car parked by the kerb, and said he came out in front of it. The defendant denied negligence, and his explanation was that .plaintiff came out from the blind side of the parked car and was so close to the taxi that there was no chance of avoiding him. Excessive speed was denied. Evidence in support of the claim was given by plaintiff and Dr. McCaw. For the defence evidence was given by defendant, a Transport Board employee, and a passenger who .was in the taxi and said, the speed was not excessive. The case is proceeding.
