APPEAL DISMISSED.
INJURED MESSENGER'S CASE. The sequel to an accident which occurred in Beach Road on July 7, 1931, was heard before Mr. Justice Herdman to-day, when he considered an appeal against a decision by Mr. F. K. Hunt, S.M. Appellant was Keith Scott, a tele, graph messenger, aged 18, and respondent was Alfred William Allan, a lorry driver, in the employ of Messre. Radley, and Co., fruit salesmen, of Auckland. Appellant alleged negligence against Allan, whose lorry knocked him down when riding a bicycle. Mr. Hunt had found in favour of defendant, and today's appeal was against this decision on points of law and of fact. His Honor upheld the magistrate's decision, ari dismissed the appeal.
